DEFINITIONS

"We," "Us," "Our" refers to AJI Imports Pty Ltd trading as Veloce Fermati
"You," "Customer," "Buyer" refers to the person or entity purchasing products
"Products" refers to two-piece floating brake rotors and related components
"Website" refers to velocefermati.com.au and all associated domains

ELIGIBILITY

You must be at least 18 years old to purchase from us. By placing an order, you represent that you are of legal age and have the authority to enter into these terms.

PRODUCT INFORMATION

Accuracy: We make reasonable efforts to ensure product information is accurate. However:

Vehicle manufacturers may change specifications without notice
Products may differ slightly from images
Specifications are subject to change
Minor cosmetic variations are normal

Fitment Verification: You are responsible for verifying fitment before ordering. Contact us with your VIN if unsure.

Safety-Critical Components: Brake rotors are safety-critical components. Professional installation by a qualified mechanic is strongly recommended. Self-installation is at your own risk and voids the express 12-month manufacturing warranty. A receipt of professional installation is required to make a warranty claim.

PRICING

Currency: All prices are in AUD and include GST.

Price Changes: Prices may change without notice. Your order is charged at the price displayed at checkout.

Pricing Errors: If a product is listed at an incorrect price:

We reserve the right to cancel the order
We will notify you and offer the option to purchase at the correct price or receive a full refund
We are not obligated to honour pricing errors, even if payment was processed

ORDERS AND PAYMENT

Payment Required: Payment must be received before shipping.

Order Confirmation: You will receive email confirmation when your order is placed. This does not constitute acceptance of your order.

Right to Refuse: We reserve the right to refuse or cancel any order at our discretion, including for product availability issues, pricing errors, suspected fraudulent activity, violation of these terms, or customer history of abuse or chargebacks.

Order Cancellation:

Before shipping: contact us immediately for a full refund
After shipping: order cannot be cancelled — see our Return and Refund Policy
Made-to-order products: cannot be cancelled once production begins

CUSTOMER CONDUCT

We maintain a zero-tolerance policy for abusive, threatening, or harassing behaviour toward our staff.

Prohibited conduct includes:

Verbal abuse, profanity, or offensive language toward staff
Threats of violence or harm
Harassment via email, phone, or social media
Sexual harassment or inappropriate communications
Discriminatory or hateful speech
Impersonation of our company or staff
False or defamatory statements
Attempts to manipulate or extort

First offence: Written warning; order may be cancelled; refund processed minus costs incurred.

Second offence or severe violation:

Immediate and permanent ban from all services
If order not yet shipped: refund issued minus any costs incurred
If order already shipped or in transit: no refund; you may refuse delivery but no refund will be issued
Legal action may be pursued for threats, defamation, or harassment

We reserve the right to share information with law enforcement if threatened, and to pursue legal action for damages caused by abusive behaviour.

CHARGEBACK POLICY

We stand behind our products and will work with you to resolve any legitimate concerns. Contact us before initiating a chargeback — most issues can be resolved directly.

A chargeback is considered fraudulent if:

You received the product as described
You initiated a chargeback for a dispute resolvable under our policies when you were able to contact us
You file a chargeback after we have already provided a resolution
You retain the product and receive a chargeback refund

Consequences of chargeback abuse:

Immediate account suspension and permanent ban from future purchases
We will contest all fraudulent chargebacks and pursue legal action and debt collection where applicable
Blacklisted from all our brands and services

Legitimate chargebacks: We recognise chargebacks may be necessary if you did not authorise the transaction, your card was used fraudulently, we failed to deliver after a reasonable period, or we breached our agreement. In these cases, we will work with your financial institution to resolve the matter fairly.

INTELLECTUAL PROPERTY

All content on our website — text, images, logos, designs — is our property or licensed to us. You may not copy, reproduce, use commercially, or claim our content as your own without permission.

By submitting photos, reviews, or other content to us, you grant us a worldwide, royalty-free licence to use it for marketing purposes, and confirm you own the rights to that content. To opt out, email info@velocefermati.com.

LIMITATION OF LIABILITY

To the extent permitted by law, our total liability is limited to replacement of the product or refund of the purchase price.

We are not liable for:

Vehicle or property damage
Personal injury or death, except where caused by our negligence
Installation, removal, or labour costs
Towing or recovery costs
Loss of vehicle use or downtime
Brake system component damage (calipers, pads, lines, master cylinder)
Wheels, suspension, or drivetrain damage
Economic loss or lost profits
Indirect or consequential damages
Any claim arising more than 12 months after purchase

Track and Motorsport Use: Use of our products in motorsport is at your own risk. We accept no liability for damage, injury, or loss from track use.

Professional Installation: Improper installation voids the express 12-month manufacturing warranty. We cannot exclude liability under Australian Consumer Law for negligence or breach of consumer guarantees.

AUSTRALIAN CONSUMER LAW

Nothing in these terms excludes your rights under Australian Consumer Law. You are entitled to:

Replacement or refund for a major failure
Compensation for reasonably foreseeable loss
Repair or replacement if goods are not of acceptable quality

These rights cannot be excluded by these terms.

PRIVACY AND DATA PROTECTION

We collect information necessary to process orders: name and contact details, shipping address, payment information, and vehicle information for fitment. We do not sell or share your information except with shipping carriers, payment processors, and as required by law. You may opt out of marketing communications at any time.

MODIFICATION OF PRODUCTS

Products must not be modified in any way. Modifications immediately void all warranties and may render the product unsafe. Prohibited modifications include machining or resurfacing friction surfaces, drilling additional holes, swapping bells between different rotor sets, using non-OEM hardware, painting friction surfaces, or any alteration to product design.

FORCE MAJEURE

We are not liable for delays or failures due to circumstances beyond our control including natural disasters, pandemic, war, government restrictions, carrier delays or strikes, or supply chain disruptions.

DISPUTE RESOLUTION

Contact us first — most issues can be resolved directly. These terms are governed by the laws of Queensland, Australia. Any legal action must be brought in the courts of Queensland. If we prevail in legal action, you agree to pay our reasonable legal costs.

GENERAL

We may update these terms at any time. Changes take effect when posted. The version in effect at time of purchase applies to your order. If any provision is found invalid, the remaining provisions remain in effect. These terms, together with our Return and Refund Policy, Shipping Policy, Warranty Policy, and Legal Notice, constitute the entire agreement between you and Veloce Fermati.

RIGHT TO REFUSE SERVICE

We reserve the right to refuse service to anyone at any time, including for history of abusive behaviour, chargeback abuse, fraudulent activity, violation of these terms, or unreasonable conduct. This includes refusing new orders, cancelling existing orders, and permanent banning from future purchases.
